B’alert+ Last update: August 2022 Welcome to the Internet sites of B’alert+ . In the present document, en ocasiones, B’alert+ is sometimes referred to herein as “we”, “us” or “our”.
THE USER MUST READ THESE CONDITIONS OF USE CAREFULLY, by using B'alert+, the user expresses his agreement with these conditions of use. If you do not agree with these conditions of use, the user should not use B'alert+.
B’alert+, can modify these Terms of Use at any time by updating this posting. The user will be bound to any modification that is made and, therefore, must visit this page regularly to consult these Conditions of Use.

1. B’alert+ property

B’alert+, is a trademark registered by AlerPlus HP SpA, a company with fiscal residence in Santiago de Chile.

2. Use of the B’alert+ brand

The content included in B’alert+ ,such as text, graphics, images, audio, video and other material, as well as the names, labels, organization and appearance displayed to the user (collectively, the "Content"), are protected by copyright and trademark laws, and by other related laws of the United States and other countries; and are owned or controlled by AlertPlus HP SpA.
Unauthorized use of the Content may violate copyright and trademark laws, as well as other laws.
The use of the content in any network environment for any purpose is prohibited, without the express prior written authorization of AlertPlus HP SpA. If the user wishes to obtain more information on how to receive authorization to use the content, he must send an email message email to contacto@balertapp.com.

3. Privacy

B'alert+ is committed to respecting and protecting data privacy. In this privacy statement, it is reported how it treats the data that you provide through the B'alert+ application.

Information in application

All the information that you provide to the application and that obtained from the evaluations carried out is secure and encrypted. Part of the accumulated information is sent to our web platform called cloud B'alert+, sending it safely and encrypted.

Information on web platform

The web platform used by B'alert+, called Cloud B'alert+, is located on Amazon AWS servers, which meet high security standards, guaranteeing information protection.

4. Use of the B'alert+ Application

By using the application, you agree to the following terms of use and privacy established by AlertPlus HP SpA:

• B'alert+ has been prepared for use by workers over 18 years of age.
• The information received is stored on a web platform called Cloud B'alert+.
• The information received will not be shared in any format with other companies or people, and will only be used by the AlertPlus medical area to define actions to follow, which will improve people's health.
• The information received is kept on the Cloud B'alert+ platform while the client associated with the worker is active.
• The information received could be used (taking care of the private information of people), to carry out studies and its publication in international journals, which allow improving the efficiency of B'alert+.
• The information received could be presented to the client associated with the worker in report format, for their management.
• In the unlikely event of information hacking, AlertPlus undertakes to notify the associated client and the competent authorities so that the corresponding measures can be taken.
• In case of trial, the Chilean courts are established as the valid ones
• The information is encrypted in the mobile application and on the Amazon AWS web platform, which has the highest security standards in the industry
• AlertPlus HP SpA reserves the right to terminate the service, in case of breach of contract by the client and/or distributor associated with the worker, which will cause the worker to no longer be able to access the application services.

Data from Health Applications

B'alert+ , uses data associated with hours of recent sleep (if the user authorizes access from their mobile phone) in Healthkit for Ios, and GoogleFit for Android. These data are exclusively used to improve the user experience, making recommendations that improve people's health, and will not be shared with any company or person. The user can cancel the permission at any time he deems necessary using the configuration tools of his mobile phone, this will not affect the operation of B'alert+.

Geolocation data

B’alert+, uses data associated with geolocation (if the user authorizes access from their mobile phone). These data are exclusively used to improve the user experience, they will not be shared with any company or person. The user can cancel the permission at any time he deems necessary using the configuration tools of his mobile phone, this will not affect the operation of B'alert+.

5. Access Accounts

B’alert+, for some services requires the user to have an account in order to use the application with all features. The user agrees to provide, maintain and update complete, true, accurate and current personal information as requested in our application The user agrees not to impersonate any person or entity and not to misrepresent their identity or affiliation with any person or entity, including the use of another person's name, or any account information, or another person's name, likeness, voice, image, or photograph. Likewise, the user agrees to notify us immediately at activator@balertapp.com of any unauthorized use of their username, password or other account information, or any breach of security of which they are aware.
We may suspend or terminate a user's account and the ability to use any part of B'alert+ due to a breach of these terms of use or any special terms related to a particular service.

6. B'alert+'s responsibility

B'alert+ does not make any representation or guarantee regarding the accuracy, reliability, integrity or validity of the content or about the results that must be obtained from its use. Modifications are made to the B'alert+ services periodically and such modifications may be made at any time.
B'AELRT+ OR ALERTPLUS SPA DOES NOT GUARANTEE THAT THE SERVICES WORK WITHOUT ERRORS OR THAT THERE ARE NO COMPUTER VIRUSES OR OTHER HARMFUL ELEMENTS. IF THE USE OF THE B'ALERT+ SERVICES OR THE CONTENT BY THE USER CAUSES THE NEED TO REPAIR OR REPLACE ITS EQUIPMENT, OR LOSS OF PROFITS OR DATA, B'ALERT+ or AlertPlus SpA WILL NOT ASSUME RESPONSIBILITY FOR THESE COSTS.
THE B’ALERT+ SERVICES AND THE CONTENT ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND. THIS, TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION WARRANTY OF MERCHANTABILITY, WARRANTY OF NON-INFRINGEMENT OF PROPRIETARY OR THIRD PARTY RIGHTS, AND WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.
B'ALERT+ SHALL MAKE ALL REASONABLE EFFORTS TO PROTECT ANY INFORMATION OR DATA SUBMITTED BY THE USER IN CONNECTION WITH ANY SERVICE OR FEATURE OF THE APPLICATION, BUT USER AGREES THAT SUBMISSION OF SUCH INFORMATION OR DATA IS AT THE USER'S OWN RISK. THE USER HEREBY RELEASES B'ALERT+ FROM ANY LIABILITY TO USER FOR ANY LOSS OR LIABILITY RELATED TO SUCH INFORMATION.
